The definition of fireworks is a bit loose, but Florida officials define the term of firework as anything that explodes or launches in any way.

This would exclude approved types of sparklers or snap rocks. The Florida Fire Marshall publishes a list of approved sparklers each year for your convenience, and you can find them at many local stores.

Other exclusions may be made for grounded items that sizzle as opposed to exploding.

These exceptions include:

  • Entities registered with the state marshal. This is usually exclusive to distributors, wholesalers, or manufacturers.
  • Public displays authorized by the county. For example, a local pier restaurant may receive official authorization to have a fireworks show off of their pier location.
  • Emergency flares

This does not leave a lot of wiggle room. Most types of fireworks are not legal, even from one’s own backyard.

Can You Buy Fireworks in Florida?

You cannot legally buy fireworks in Florida. Stores certain allows fireworks to be sold for legal purposes such as using them to scare off birds from farms or fish hatcheries.

A waiver must be signed that the fireworks are going to be used for this purpose – unfortunately, they can’t be used for a backyard show and lying on the form is a first-degree misdemeanor.

Are There Fines Associated with Launching Fireworks?

There are penalties of up to one year of jail time and up to $1,000 in fines for illegally launching fireworks. During the Fourth of July, officers may be stationed at popular beach spots to make sure the locals and visitors are safe.

The main reason here has to do with safety and fire regulation. It can be quite dry in the summer during parts of the day, despite the high humidity.
